The Maltese femicide law is being challenged at our Constitutional Court: Malta’s Men’s Rights Foundation insists that all laws should be equal for both genders.

This site was one of the few media outlets that challenged the government and the opposition for supporting and eventually introducing the femicide laws in our criminal code. It was stated that this law was unconstitutional and went against fundamental human rights. Yesterday, we read in the news that the lawyers defending Roderick Cassar, who is accused of his wife’s murder, are now challenging this law in our constitutional court. They have a huge chance to win the case hands down. This law is unconstitutional from the very start. This is what happens when amateur politicians run a country. Both government and opposition would seek to play to the media’s tune with disastrous consequences for our country. What needs to be stated is that the submissions made by the lawyers of Cassar have many valid points. One cannot enact laws that a priori discriminate between the sexes. One of the fundamental elements of jurisprudence is that the law is equal for everybody.

In the meantime, the Men’s Rights Foundation issued a statement reiterating that the existing femicide laws in Malta are, by their very nature, discriminatory against men. Rightly so, this Foundation argued that there could not be a law regulating one gender and another law regulating another gender. If, in Malta, we believe that our civil and criminal law is built on the principles of equality and equanimity, this situation cannot be allowed to exist. The Men’s Right Foundation insists that it is not condoning the murder of Bernice Cassar. Instead, this Foundation urges that all citizens have equal rights in front of the law.
