Magistrate Axiak indirectly states that Magistrate Montebello based her decree on antiquated laws.
Today, Magistrate Victor Axiak delivered a verdict regarding the publication of snippets from the recordings that where presented in court by the police regarding the compilation of Yorgen Fenech. Magistrate Montebello imposed a ban on the publication of part of these recordings that Melvin Theuma, a liar and crook, gave to the police. These banned recordings or part of them were published on the website Reddit. The Malta Today republished them. For this reason, the Malta Today became liable for contempt of court. In court, Malta Today stated that it did not obtain these records from Reddit but through the recordings held by the police! But the truth remains, that Malta Today published them after they appeared on Reddit and despite the ban of the magistrate Montebello. Magistrate Axiak delivered his sentence regarding the publication of these banned recordings by Malta Today. In his sentence, the magistrate dismissed the accusation against Malta Today because the laws are antiquated laws thus highlighting Magistrate Montebello did not follow procedure to the full. Once her ban had not been affixed on her courtroom door as specified by the law, this ban only bound those individuals present in her courtroom at the time and nobody else.
The question to be asked is why did Magistrate Montebello put individuals – including the undersigned – under contempt of court? It should be noted that it is a fact that such a notice was never affixed on her courtroom door. Therefore, why did Magistrate Montebello put me under contempt of court when she – and this is now confirmed by Magistrate Axiak – did not follow the correct legal procedure?
It is opportune to remind the readers that I was put under contempt of court at the insistence of Daphne Caruana Galizia’s family through their lawyer Jason Azzopardi. Azzopardi stated at the time that I broke the ban imposed by Montebello through the republishing of these recordings. It is tragic that the Caruana Galizia’s family, who wants us to believe that they are the non plus ultra of rectitude did not ensure that the notice ban was indeed affixed according to law. After all, they were present in court when this ban was delivered. As parte civile, their lawyer should have pointed this out to Magistrate Montebello. In his petition to Magistrate Montebello, Azzopardi even argued that, more likely than not, I am part of a criminal organization because I had infringed a court order! I seize this opportunity to reiterate that I never published or republished such recordings. What I did was to refer to the fact that Reddit published new recordings.
On our islands, we have reached the Kafkaesque absurdity that seven newsrooms unite against a contempt of court order when these same seven newsrooms were all at the time in support of Magistrate Montebello when she imposed such a contempt of court on an ordinary citizen at the instigation of the family Caruana Galizia. These same seven newsrooms then united against me and wrote articles which were intended to delegitimize me on the grounds that I had defied a magistrate’s order as also stated by the Caruana Galizia’s lawyer. Now another magistrate is taking a different stand on the same issue of contempt of court. This shows the arbitrariness and the big mess that the Caruana Galizias have created in our judicial system through their maliciousness. Montebello’s stand in support of the Caruana Galizias is making me unnecessarily incur a lot of legal expenses.
When Magistrate Montebello put me under contempt of court, Saviour Balzan of Malta Today, was all in praise of Montebello’s action. Manuel Delia – who is financed by the EU and has the support of the Venice Commission – made a whole pavlava in his book praising how wise Magistrate Montebello is in her actions against me. He used the fact that Montebello put me under contempt of court to maintain that I am corrupt. Now, another magistrate is showing that Delia’s whole argument is, to say the least, fallacious!
This is another clear case why justice in Malta is not being served. It is obvious that justice in Malta is not only not seen to be done but is blatantly abused left right and centre to accommodate the Caruana Galizia family.
This is why ordinary citizens have lost complete faith in our judiciary system.
